Lavina Kft. – General Terms of Online Sales and Use
Effective from: July 1, 2022

This document is not filed, it is concluded exclusively in electronic form and does not constitute a written contract. It is written in Hungarian and does not refer to any code of conduct. If you have any questions regarding the operation of the webshop, the ordering process, or delivery, please contact us using the contact information provided below.

These Terms and Conditions (hereinafter: “T&C”) govern the legal relationships established through the use of the service provider’s website (https://lavinafree.hu) and its subdomains.

2. General Provisions

2.1. Any issues not regulated by this Policy and its interpretation are governed by Hungarian law, particularly Act V of 2013 on the Civil Code (“Ptk.”), Act CVIII of 2001 on Electronic Commerce Services, and Government Decree 45/2014 (II.26.) on consumer-business distance contracts. Mandatory provisions of the relevant legislation shall apply to the parties without specific stipulation.

2.2. These T&C are effective from July 1, 2022, and remain in force until revoked. The Service Provider reserves the right to unilaterally amend the Policy. Changes will be published on the website at least 11 (eleven) days before taking effect. By using the website, users accept that all regulations relating to the website apply to them automatically.

2.3. By accessing or using any content on the website operated by the Service Provider, the User (even if unregistered) agrees to be bound by the provisions of these T&C. If the User does not accept the conditions, they are not entitled to view the website’s content.

2.4. The Service Provider retains all rights to the website, including all parts, content, and the distribution of the website. Downloading, storing electronically, processing, or selling any part or content of the site without the Service Provider’s written permission is strictly prohibited.

3. Registration / Purchase

3.1. By registering or purchasing from the website, the User declares that they have read and accepted the provisions of these T&C and the Privacy Policy published on the website and consent to data processing.

3.2. During registration or purchase, the User must provide their own real data. If untrue or third-party data is provided, the resulting electronic contract shall be considered null and void. The Service Provider excludes any liability if a User uses services in another person’s name or with another person’s data.

3.3. The Service Provider shall not be liable for any delivery delays or other issues caused by incorrect or inaccurate data provided by the User.

3.4. The Service Provider shall not be held liable for damages resulting from the User forgetting their password or if unauthorized third parties gain access to it for any reason not attributable to the Service Provider.

4. Products and Services Available

4.1. Products displayed in the webshop can be ordered online. Prices are in HUF and include VAT, delivery, and packaging costs.

4.2. Minimum order quantity is 1 carton (4 packages).

4.3. The Service Provider reserves the right to change prices. If a User orders a product at the price shown on the website and it is confirmed to be in stock, they will receive it at the recorded price.

4.4. In case the ordered product is not in stock, the User will be informed and offered a chance to reorder. The reordering price cannot be guaranteed.

4.5. Product descriptions and images are displayed for reference. Images may differ from actual products. The Service Provider is not liable for discrepancies between product images and the real appearance.

4.6. Promotional pricing and its duration will be clearly communicated to Users.

4.7. In case of erroneous pricing (e.g., HUF 0 or 1 due to system error), the Service Provider is not obligated to fulfill the order but may offer the product at the correct price. The User may choose to cancel the order.

4.8. Obvious pricing errors constitute a disproportionate deviation from the real price and cannot lead to a valid contract.

4.9. The expiration date means the product is safe to consume until that date. Products must not be consumed past their expiration date.

5. Ordering Process

5.1. Users can start shopping after registration or without it.

5.2. Select desired products and quantities (minimum 4-pack and multiples thereof).

5.3. Add items to cart and review contents anytime.

5.4. Modify quantity or remove items before checkout.

5.5. Provide billing/shipping address and select payment method:

  • Online payment via Barion

  • Barion Wallet balance

What is Barion?
Barion is an electronic payment service allowing secure online transactions via card or wallet. Card details are not shared with the merchant.

5.5.2. Shipping is always free of charge.

5.6. If errors occur in pricing or product display, the Service Provider reserves the right to correct them and notify the User, who may confirm or cancel the order.

5.7. The total payable amount includes all charges and will be confirmed via email.

5.8. Clicking the “Pay with Barion” button completes the order. The User can review details before finalizing and add notes if necessary.

5.9. Input errors can be corrected before submitting the order.

5.10. Confirmation email will be sent within 48 hours. If not received, the User is not bound by the order. Delivery is weekdays 8:00–17:00.

6. Order Processing and Fulfillment

6.1. Orders are processed during business hours; after-hours orders are processed the next day.

6.2. Standard fulfillment: within 1 business day from confirmation.

6.3. Sale contracts obligate the Provider to deliver, and the User to pay and accept delivery.

6.4–6.8. Fulfillment, risk transfer, and delays follow Hungarian Civil Code and EU regulations.

7. Right of Withdrawal

7.1–7.24. Withdrawal terms follow EU Directive 2011/83 and Gov. Decree 45/2014 (II.26.).

Users may cancel orders within 14 days without justification. The full withdrawal policy includes procedures, exceptions (e.g., perishable or personalized goods), costs, timeframes, and refund terms.

8. Warranty and Guarantee

8.1–8.17. Users are entitled to:

  • Warranty (defective goods handling under Hungarian Civil Code),

  • Product Warranty (manufacturer responsibility),

  • Guarantee (where applicable by law).

Obligations, timeframes, and user rights detailed according to Hungarian and EU law.

9. Warranty Claim Procedure

Describes how to file claims, the required documentation, deadlines, and the Service Provider’s obligations to respond, document, and resolve within legal deadlines.

10. Miscellaneous Provisions

10.1–10.4. Validity, use of subcontractors, partial invalidity, no waiver, and dispute resolution principles.

11. Complaints Handling

11.1–11.10. Users may submit complaints via phone, email, or post. Includes official complaint protocols, response time (30 days), authority contacts, and consumer rights enforcement bodies (including EU ODR platform).

12. Copyright

12.1–12.6. Website content is protected by copyright. Unauthorized use, adaptation, or reproduction is prohibited. Damages and penalties apply in cases of infringement.
